BASIC PAYMENT SCHEME (BPS)

The land is registered on the Rural Land Register and used to claim BPS Entitlements.  The Purchaser(s) will be required to provide an indemnity for the 2022 cross compliance period.    BPS entitlements are available to purchase by separate negotiation from the previous occupier of the land.

DESIGNATIONS

Part of Lot 3 is included within the River Derwent SSSI and a Special Area of Conservation.  The land is not within a Nitrate Vulnerable Zone.

SPORTING AND MINERAL RIGHTS

The mineral rights are reserved together with the associated rights to work the minerals.   The sporting rights are included in the sale, but let to a third party.  The agreement can be terminated on serving the required notice.    

 INGOING VALUATION

An ingoing valuation will be payable by the purchaser(s) for any seeds, fertilisers, cultivations, sprays and acts of husbandry applied to the land or undertaken after harvest 2022 and prior to completion.

OVERAGE

The land is to be sold subject to an overage provision reserving 50% of any uplift in value should the use of the land change (with or without planning permission) within 25 years following completion.
